By using this site and services and/or products, you consent to be bound by our terms and conditions. “Services” means, collectively, the workshop, subscription, seminar, conference, and other related services provided in connection with the Site, and “Products” means, collectively, the publications, workshop replay, and other materials and products available through the Site. Also, you are subject to the IES Privacy Policy and, when using any particular information, Products, Services or Content (as defined below) available through the Site, any additional terms and conditions posted in connection with such information, Products, Services or Content (collectively, “Additional Terms”). You agree that IES may modify these Terms and Conditions, the Privacy Policy and any Additional Terms at any time and from time to time, with or without notice to you. When you access, use or browse the Site, the Products, and / or the Services, you accept, without limitation or qualification, these Terms and Conditions and any Additional Terms as if you had signed them.
1. Use and Restrictions
1.1 IES will use reasonable care and skill to provide:
1.1.1 The Workshops for which the applicant is enrolled, including the provision of event materials.
1.2 IES will acknowledge receipt of the application and invoice the Applicant accordingly.
1.3 The applicant agrees to pay the workshop fees before the start of the workshop once the confirmation email sent.
1.4 The applicants shall not use this site in an unlawful manner. Applicants must respect website terms and conditions and follow the privacy policy.While attending an IES Workshop, applicants act with respect and courtesy towards all audience, workshop leaders, staff, and other attenders.
1.5 The applicants shall not submit, display or transmit any images, photographs, graphics, links, audio files, video files or similar content with the intent to interrupt, limit or otherwise impact the performance of the Site or otherwise exceed IES’ bandwidth capacity.
1.6 The applicants shall not unless otherwise permitted by IES in the applicable Additional Terms or a separate agreement, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works of, transfer, or sell any Content.
2. Use: Register
2.1 The Site, the Content, Services and/or the Products are not intended to be used by individuals under the age of eighteen (18). You may access and browse certain areas of the Site and the Content without registering and / or paying for certain workshops. You must register and pay in order to access certain Products and/or Services or participate in certain workshops, forums, conference and seminar opportunities or other IES programs. In order to access to participate in workshops, you must complete the registration and payment processes. The registration and payment processes require among other things, that you provide current, complete and accurate information as requested on the applicable registration forms and that IES is able to successfully process your payment information. If you are registering on behalf of a school, school system, business entity or other organization, you represent and warrant that you have the authority to provide the required information and bind the organization to these Terms and Conditions and the applicable Additional Terms.
2.2 Notwithstanding the foregoing, you acknowledge and agree that IES, in its sole discretion and without notice or any further obligation to you, may: (a) temporarily suspend or permanently discontinue your, and refuse any and all current and future, access to or use of the Site and / or the Products and Services, or (b) take any other necessary or appropriate actions in case of technical problems, objectionable material, false, misleading, unlawful or inaccurate postings, articles or other contributions.
3. Confidentiality
3.1 The applicants acknowledge and agree that any user name, login code, identifier or password is confidential information. The applicants must maintain the confidentiality of any Password, and may not disclose such Password to any other person or entity or permit any other person or entity, to access the Site or the Services and/or Products using such Password. The applicants acknowledge and agree that the applicants are responsible for any use of your username, user ID, login and / or Password, including any fees incurred. The applicants agree to notify IES immediately of any unauthorized use of any Password which you are aware. The applicants may not use any Password that is not issued directly to the applicants or approved by IES.
3.2 IES cannot be responsible, and disclaims all liability in connection with, the use of any information that the applicants submit, post or display on the Site. The applicants should use caution when posting any information, including personally identifiable information to the Site.
4. Links to Third Party Websites
4.1 The Site may contain links to websites and other resources operated by third parties other than IES. Such links are provided solely as a convenience to you. IES does not control such websites, and is not responsible for the contents, or products, services or other content offered through such websites. IES’s inclusion of links to such websites does not imply any endorsement of any website, or the content, products or services offered through any website, or of any company or person. If you decide to access any third party websites, you do so entirely at your own risk, and you may be subject to the terms and conditions and the privacy policies of such websites.
5. Limitation of Liability
5.1 IES and its employees, agents, consultancies, workshop leaders and third party partners will not be liable for any indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, whether or not IES has been previously advised of the possibility of such damages, whether in an action under contract, tort, or any other theory, arising out of or in connection with any errors or omissions, viruses or other malicious or unauthorized code or programs, the use, inability to use, or performance of the site or the content, products or services available from the site or any loss, or other damages in connection therewith. Without limiting the foregoing, IES’s liability in connection with the site, the content, the products, the services or these terms and conditions shall be limited to the amount paid for the site, the content, the products or services giving rise to the claim. These limitations will apply notwithstanding any failure of essential purpose of any limited remedy.
6. Indemnification
6.1 You agree to indemnify, defend and hold harmless IES and its employees, agents, consultancies, workshop leaders and third party partners from and against all claims, losses, expenses, damages and costs (collectively, “Damages”), including reasonable attorneys’ fees, resulting from: (a) any violation by you of these Terms and Conditions or any applicable Additional Terms, and (b) any Register Content provided by you.
7. Privacy and data protection
7.1 Any information that is provided will be treated in accordance with IES’ Privacy Policy available here, for the purposes of providing the services and/or products requested. It may also be used for customer management purposes. By providing this information, the applicant consents to the use of this information for these purposes.
7.2 The applicant agrees that the organisers can use photographs of the applicant taken during the event for their marketing purposes.
